If you have any questions or concerns, text or call us at (754) 308-8745. STEP 2: Once you have reviewed this document, you simply agree to the terms by entering your full name on the form and click the “I have read and agree to the terms and conditions listed above” box to complete this process. ** If you do not agree with our terms and player/parent expectations, we simply ask that you do NOT enroll into our program. Our terms are extremely clear and protect the integrity of our program. Our program is selective and certainly NOT for every family. We only want to work with families who truly buy into our culture at PAC PERFORMANCE. ** 1. TERMS: This Agreement will begin on the day you register and continue monthly up until you cancel your membership. If you choose to cancel, I agree to provide PAC Performance with a 7 day written notice at pac.perform@gmail.com to cancel any future recurring payments after the contract is complete. If you do not follow our terms, you will be automatically enrolled into the same agreement for the month no exceptions. By registering for the program, you agree to the “terms and conditions” below, the player expectations and the parent expectations that clearly states PAC PERFORMANCE’S refund, cancellation details, and early termination policy. 2. PLAYER EXPECTATIONS: - I agree to be a positive player who is coachable. - I agree to complete each homework tasks that PAC Performance assigns me in a timely manner. - I agree to be accountable to PAC Performance's program and not make excuses. - I agree to bring a full water-jug and my own basketball to each session. - I agree to wear the proper attire (i.e basketball shoes, shorts, t-shirt) to each session. - I agree to work hard and achieve my personal goals that PAC Performance and I set. - I agree to be committed every week and dedicate time to work on my own away from our sessions. - I agree to use the additional resources and “at-home videos” that PAC Performance provides for me. - I agree that I can communicate with PAC Performance daily about my progress via text messaging. - I agree to put in the work needed to become a better player. My results are my responsibility. 3. PARENT EXPECTATIONS & TERMS: A. TERMS: - Once you become a member, all communication is done through text messaging. - If parents have questions during the week, you can ask us questions via text messaging and will receive a response within 12 hours Monday through Friday. - We have a very clear NO REFUND policy. All sales are final once you enroll into our program. - If training is cancelled due to weather or family emergencies, we will notify the PLAYERS and PARENTS through text messaging. If a session is cancelled due to weather, the session will be made up the week of or the following week. Training updates/cancellations will be communicated via text messaging. B. PARENT EXPECTATIONS: - I agree to bring my child to our scheduled weekly session 15 minutes early to warm up and stretch. - I understand that if we are late to the session we will forfeit the time. All sessions last 60 minutes. - I agree with PAC Performance's Reschedule policy, meaning if you miss that session, we do NOT offer a private 1-1 makeup session. If you want to reschedule a session, the Parent must provide prior notice 24 hours in advance to PAC Performance BEFORE the session. If not, the parent and player will lose that session if they do not attend. - I understand that my child has access to PAC Performance outside of our sessions via text messaging in order to ask him any questions and/or receive daily mentorship throughout the week. As a parent, if I have questions, I understand that I can ask questions anytime via text messaging. Text messaging is our ONLY method of communication. - I understand that during the sessions, I will not pressure my child or yell from the sidelines. We train in a “non-pressured” environment. - I understand that PAC PERFORMANCE will decide the “rain-out’s” or rescheduled sessions due to weather conditions. PAC PERFORMANCE will always check court conditions before the sessions and will communicate via text messaging if there is a cancellation. If a session is cancelled due to weather, the session will be made up either later that week or the following week. It will be well communicated IF we do not have an in-person training session, The PLAYER and PARENT will receive a notification via text messaging the day BEFORE the session stating the cancellation. - I understand how to communicate with PAC Performance if and when there are conflicts/vacations, in advance, so we can better prepare for our sessions. - I understand that if we are “out of town” or “on holidays” that we are still a member of the program. Please communicate with PAC Performance when you are going out of town so we can plan accordingly. Our program runs year long except on days where training gets rained out and on the following major holidays: - Fourth of July - Thanksgiving - Christmas Eve/Day - New Year Eve/Day - Spring Break - Memorial Day Missed sessions do NOT roll over into the following month/term for any reason. - I understand that PAC PERFORMANCE'S billing process is an automatic electronic funds transfer that will charge me automatically every month up until my membership is no longer active. - I understand that if I have a “failed credit/debit card payment” I will need to register with a new credit or debit card within 24 hours of the failed payment. Sessions will pause until the payment is collected. All sales are final. If you enroll and do not use the sessions, there are no make-up sessions for missed sessions. - We offer a monthly plan with different session options. If you want to CANCEL your membership, please notify us 7 days BEFORE the end of our agreement. By doing so, we will cancel the account. If not, you are auto-renewed into the next training term automatically. You can notify us in writing at pac.perform@gmail.com at least 7 days BEFORE our final session and we will cancel the membership. - I understand PAC PERFORMANCE, Coach Paul and any assistant coach for PAC PERFORMANCE is not liable for any injuries. Our Terms and Conditions apply to any training program offered by PAC PERFORMANCE. By scheduling any session, you are agreeing to the following terms and conditions of our company: A. SOCIAL MEDIA RELEASE POLICY: “I, the undersigned, do hereby grant permission to PAC PERFORMANCE LLC to post me and/or my child’s story, photo, videos, hereinafter referred to as “Materials” taken by PAC PERFORMANCE LLC during sessions or that I, the undersigned, submit to and for the PAC PERFORMANCE website, Instagram, Tik Tok, YouTube and Facebook accounts. I hereby release you, your representative, employees, managers, members, officers, parent companies, subsidiaries, and directors, from all claims and demands arising out of or in connection with any use of said “Materials”, including, without limitation, all claims for invasion of privacy, infringement of my right of publicity, defamation and any other personal and/or property rights”. B. HEALTH AND WELLNESS POLICY: "I have enrolled in the personalized youth athletic development program offered through PAC PERFORMANCE LLC. I recognize that the program may involve strenuous physical activity including, but not limited to, muscle strength and endurance training, cardiovascular conditioning and training, and other various fitness activities. I hereby affirm that my child is in good physical condition and does not suffer from any known disability or condition which would prevent or limit my participation in this exercise program. I acknowledge my enrollment and participation in PAC PERFORMANCE'S sessions and training." “I fully understand that my child may injure themselves as a result of my enrollment and participation in this program and I hereby Release and Forever Discharge PAC PERFORMANCE LLC and its agents, employees, representatives, affiliates, successors, or assigns, from any and all liability, now or in the future, for any conditions, injuries, sickness, losses, expenses or damages that I may obtain or incur. These conditions may include, but are not limited to, heart attacks, muscle strains, muscle pulls, muscle tears, broken bones, shin splints, heat prostration, injuries to knees, injuries to back, injuries to foot, or any other soreness that I may incur, including death.” C. INJURY POLICY: If injury occurs and a player is unable to participate in the training sessions, the sessions may be paused until the player is able to return to play. NO REFUNDS will be given, all sales are FINAL. D. MISSED SESSION POLICY: We have a ZERO-TOLERANCE missed session policy. If you miss a session without notice, you will forfeit the session. We respectfully request at least 24-hours advance notice for all rescheduling/cancellations. E. RAINOUT POLICY: If the courts are too wet or if there is significant rain during the morning or evening of our scheduled session, the session may be rescheduled upon PAC PERFORMANCE’S staff decision. PAC PERFORMANCE'S staff will check to ensure the court is safe before every session. If the court is playable, we will resume the session. Parents do NOT determine if the session is cancelled. If a parent decides not to attend a session that has been deemed “playable”, then that session will count as a cancellation of less than 24-hours notice and will not be eligible for makeup. For "Unlimited" session packages, if 1 out of the up to 4 sessions rains out, this will NOT be considered for a make-up session. F. PAYMENT POLICY: By signing to our Regular Training Agreement, you agree with the contract that you can commit to the entire term of the subscription. If your credit card fails, our system will prompt you to replace your card within a 24 hour period. Failure to fix the issue will result in the player NOT being able to attend any more practices or games until the issue is resolved. G. REFUND POLICY: Due to the demand for our programs, we do NOT offer refunds for ANY case for ANY program, including private training, small group training, camps, clinics, or any program that is added to our page. Once a player reserves a spot, we hold the spot for the player for the specific program. H. END OF CONTRACT & RENEWAL POLICY: If you would like to STOP training after our contract is complete, simply email us at pac.perform@gmail.com to let us know that you will be discontinuing the program. This email MUST be sent 7 days BEFORE the end of the agreement. If you do not communicate with PAC Performance by the Notice Date, you agree to continue in the program beyond the Agreement (meaning we hold your spot in the program) and the Agreement will auto-renew for the following agreed upon term. By becoming a customer of PAC PERFORMANCE, I agree to the Terms and Conditions on this website. I have signed a contract stating that I have reviewed this page in depth and agree to PAC PERFORMANCE'S Terms and Conditions. I HAVE READ AND AGREE TO THE TERMS AND CONDITIONS LISTED ABOVE.
